The Alberta Court of King’s bench has officially found podcasters David Wallace and James DiFiore guilty of criminal contempt.This decision follows their repeated harassment of Athana Mentzelopoulos, the ex-CEO of Alberta Health Services (AHS), through a series of podcasts released over the past year.

Justice Michael Lema determined that Wallace and DiFiore engaged in a calculated effort to undermine Mentzelopoulos by discrediting her publicly, aiming to weaken her wrongful dismissal lawsuit against the provincial government. The judge clarified that their conduct exceeded protected free speech boundaries, emphasizing it was neither legitimate journalism nor valid public discourse.
“Their actions amount to baseless humiliation and defamation intended solely to break down a litigant’s determination,” Justice Lema stated in his judgment.

Wallace hosted The Political Dark Arts, while DiFiore produced Blackballed with James DiFiore. Both programs contained content targeting Mentzelopoulos, including Wallace’s admission that he had been hired by undisclosed parties to “take down” her or anyone associated with her legal challenge.
