The pursuit of justice in Palestine does not begin within international courtrooms but emerges from the devastated neighborhoods of Gaza. It starts with a lawyer carefully noting down names before funerals, continues through visits to detainees who struggle to voice their suffering, and is carried forward by fieldworkers documenting injuries, collecting whispered accounts, and smuggling out evidence under constant threat.

Long before the International Criminal Court (ICC) issued arrest warrants in November 2024 against Israeli leaders benjamin Netanyahu and Yoav Gallant, Palestinian human rights defenders had already amassed a vast repository of documented abuses now under global examination.

Chronicling Violations Amidst Constant Threats

For over a decade,Palestinian organizations have diligently recorded cases involving torture,sexual violence,arbitrary arrests,attacks on healthcare facilities,child casualties,and family displacements. Despite being designated a terrorist institution by Israel in 2021 and forcibly closed by military decree, Al-Haq continues it’s work underground.

This repression extends across palestinian civil society: In 2021 alone six major rights groups-including Addameer and Defense for Children International-Palestine-were labeled terrorist entities by Israeli authorities. Their offices were raided again in Ramallah during August 2022 despite widespread international condemnation framing these actions as assaults on those exposing human rights abuses.

“Instead of investigating allegations concerning detained or tortured children,” says Ayed Abu Eqtaish from Defense for Children International-palestine, “Israeli forces targeted our office.”

The Larger Battle: Upholding Justice Amid Political power Plays

This case transcends individual suffering or isolated incidents-it challenges whether international law applies equally nonetheless of status or influence.
If laws protect only vulnerable populations while powerful actors evade consequences then true justice remains unattainable.
Courts operating solely under selective permission cannot claim impartiality.
When those exposing torture face harsher punishment than perpetrators ordering abuses we witness theatre masquerading as justice rather than genuine rule-of-law enforcement.

Fatou Bensouda holds onto hope:
“Many victims have lost faith domestically yet look toward this court hoping it embodies fairness-we must not disappoint.”

Testimonies persist, survivors have spoken loudly, lawyers carry evidentiary burdens far beyond borders-all awaiting decisive action reflecting collective conscience rather than geopolitical convenience.
