Ongoing Trial of Penticton Councillor Accused of Past Youth Sexual Abuse
A current city councillor from Penticton is undergoing a trial in Sarnia, Ontario, facing multiple charges related to alleged historical sexual offences involving minors. The court proceedings have progressed into their second day with testimony from one of the individuals claiming victimization.
Accuser Recounts Early Interactions with James Miller at Sarnia Elementary School
James miller, 60 years old and elected to the penticton city council during a 2021 by-election, remains on administrative leave amid serious allegations. He is charged with three counts of sexual interference, two counts of invitation to sexual touching, and one count of sexual assault against a person under 16 years old.
The complainant testified that his first encounter with Miller occurred during elementary school in Sarnia in the mid-1990s. At that time,Miller volunteered as a basketball coach and often gave rides home to players on his team.
The witness described Miller as “kind and reassuring,” someone who made children feel secure and appreciated. over time, their interactions shifted toward more private settings. The accuser detailed an incident during a trip to Chicago where they attended an NBA game featuring Michael Jordan; it was there that Miller allegedly asked for foot massages which escalated into inappropriate physical contact.
Allegations Extend Beyond School Environment
The testimony also revealed an unsettling event inside a sauna located within Miller’s apartment complex where he reportedly brought a condom and initiated unwanted advances. The victim expressed confusion and fear due to his young age at the time.
“Being so young then, I didn’t know how to respond or what words could describe what was happening,” he shared.
The accuser explained that fear kept him silent-fear of losing privileges such as travel opportunities since Miller had taken him to concerts like those by Bon Jovi as well as Detroit Pistons games-and other experiences including learning how to drive. he stressed the profound trust he placed in Miller throughout those formative years:
“I trusted him entirely.”

The alleged victim became visibly emotional while describing how these experiences have impacted his adult life-citing fractured relationships alongside long-standing feelings of anger and frustration accumulated over decades.
Defense Questions Chronology and Relationship Dynamics
Miller’s defense lawyer challenged inconsistencies regarding timelines-as a notable example disputing whether Michael Jordan was playing for Chicago Bulls during the claimed 2001 trip as Jordan had retired by then. They also pointed out recent communications between Miller and this individual months before charges were filed discussing unrelated topics such as hockey’s Stanley Cup playoffs.
The defense further questioned why this man permitted overnight stays by miller at his residence even after the alleged abuse period ended-suggesting ongoing contact despite accusations raised later on.
No Jury Involvement: Judge Presides Over Lengthy Trial
This case is being heard exclusively by a judge without jury participation. Scheduled over five weeks, additional testimonies are expected in upcoming sessions beginning Wednesday morning.
