Joby Aviation, a leading innovator in the electric air taxi industry, has launched a lawsuit against rival Archer Aviation.The legal action alleges that Archer illicitly obtained confidential trade secrets through George Kivork, a former Joby employee who is accused of transferring sensitive data prior to his departure.

Alleged Theft of Proprietary Information and Strategic Assets

The complaint submitted to California’s Superior Court in Santa Cruz County reveals that just two days before leaving Joby, Kivork downloaded a significant amount of proprietary documents. these materials reportedly encompassed exclusive partnership contracts, regulatory compliance strategies, plans for vertiport infrastructure and airport access points, as well as detailed technical specifications related to Joby’s aircraft design and operational procedures.

Joby claims that Archer exploited this stolen data to engage one of Joby’s key strategic partners armed with intimate knowledge of confidential contract terms. The company describes this act as purposeful corporate espionage intended to erode their market position.

“this goes beyond healthy competition; it represents intentional theft aimed at destabilizing our business,” the filing states.“We are forced to pursue legal remedies to protect our intellectual property.”

Archer Denies All Allegations and Labels Lawsuit as Frivolous

Archer’s Chief Legal and Strategy officer Eric Lentell refuted the accusations, calling them baseless attempts by Joby to impede Archer’s growth through litigation rather than competing fairly in the marketplace. Lentell noted that Kivork held a non-technical role focused on business progress and asserted ther is no proof supporting claims of misappropriation.

Lentell emphasized that Archer enforces rigorous onboarding procedures designed specifically to prevent intellectual property breaches. He characterized the lawsuit as an improper tactic meant more for distraction than seeking justice.

A Competitive Arena Fueled by Innovation and Rivalry

Both companies operate out of California and went public via SPAC mergers in 2021. They are at the forefront of developing electric vertical takeoff and landing (eVTOL) aircraft technology with ambitions extending into defense applications.

This latest conflict follows previous legal battles involving Archer; notably when Wisk Aero-now part of Boeing-filed suit against them in 2021 alleging theft exceeding 50 trade secrets through another former employee recruited by Archer. That dispute extended over two years before concluding with a settlement where both parties agreed on future cooperation efforts.
